Citation and Complaint
The Citation and Complaint is the formal document which begins the hearing process.It tells the Respondent the specific laws it is alleged to have violated and the conduct which it is alleged to have engaged in which violates those laws.
It tells the Respondent that the Respondent is required to file a written answer to the Citation and Complaint within ten (10) days of the date the Citation and Complaint was mailed.
If the answer is mailed, we must receive it within fifteen (15) days after the Citation and Complaint is mailed to you.
The Citation and Complaint is mailed by certified mail to the Respondent at the Respondent's latest address of record with the agency.
The Citation and Complaint also advises the Respondent that failure to file a written answer within the required time frame constitutes an admission by the Respondent of the allegations in the complaint and the Respondent's license may be suspended or revoked without a hearing.
Finally, the Citation and Complaint advises the Respondent that if it is found in violation, its prior record with the agency will be considered in determining an appropriate disciplinary penalty.
