ROC Revokes Home Sweet Homes L.L.C. License
PHOENIX – The Arizona Registrar of Contractors (ROC) has revoked the license of Home Sweet Home Construction L.L.C. because of the company’s violation of state statutes and failure to adequately satisfy consumer complaints as required by the Registrar effective today. Complaints filed against Home Sweet Home Construction L.L.C. have ranged from abandonment to failure to initiate the construction process after contracts were signed and earnest monies deposited.
“Our continued scrutiny of the measures taken by Home Sweet Home Construction L.L.C. to satisfy consumer complaints has fallen below our expectations and made it necessary for the Registrar to take the action ordered today.” said Brian Livingston, Assistant Director of Communications at the ROC.
Even with the revocation order being issued the ROC still maintains the statutory authority to proceed with any further investigation of or action or disciplinary proceeding against the license of Home Sweet Homes L.L.C.. Complaints that have already been filed against Home Sweet Homes L.L.C. will continue to be processed in accordance with existing procedures. In the event Home Sweet Homes L.L.C. fails to answer a complaint as it is processed, a default order will be issued by the Registrar. If the default order becomes final and provides for further suspension or revocation of the license, then a homeowner/complainant may file a claim with the Residential Contractors’ Recovery Fund. A default order becomes final 40 days after it is mailed. Should Home Sweet Homes L.L.C. file an answer to any complaint filed with the ROC then that matter will be set for an Administrative Hearing in accordance with established procedures.
The ROC suggests that all consumers affected by the activities of Home Sweet Home Construction L.L.C. continue to file their complaints with the ROC. Consumers can download a complaint form the ROC website (www.azroc.gov). Upon completing and signing the form consumers may mail or drop off the completed complaint form at any ROC office. Due to the number of complaints that have already been filed against Home Sweet Home Construction L.L.C. the ROC urges consumers not to delay in filing their complaint.
The Residential Contractor’s Recovery Fund was established in 1981 to assist residential homeowners in the recovery of actual damages caused by a licensed contractor. Each residential homeowner has the ability to recover up to $30,000 in actual damages caused by a licensed contractor. The maximum allowable payout from the Residential Contractors’ Recovery Fund is $200,000 per license. The Residential Contractors’ Recovery Fund pays claims on a first come, first served basis and for this reason the Registrar urges affected homeowners to file their complaint as soon as possible. Consumers also have the right to file civil court claims against the contractor at the same time they file their complaint with the ROC.
